Background of Appeal

On October 29, 2018, a request for an appeal hearing was submitted to the State Environmental Commission (SEC) by Avis Budget Car Rental, LLC (ABCR). The subject of the appeal concerns the rejection of the Addendum to the Offsite Corrective Action Plan for the Commingled MTBE Plume dated September 27, 2018, submitted by Broadbent & Associates, the Certified Environmental Manager (CEM), on behalf of ABCR for Avis Facility ID 8-000217.

In summary, ABCR alleges that the NDEP Corrective Action rejection of the addendum is subject to appeal based upon the NDEP determination that the addendum is not necessary, that previous corrective actions are sufficient, and that NDEP determined the MTBE Plume does not pose an unacceptable risk to human health and the environment.
