Albemarle US, Inc.
Alleged failures to construct or operate a stationary source in accordance with any conditon of an operating permit, in violation of Class II Air Quality Operating Permit AP2819-0050.
Recommendation: Approve the NDEP-recommended penalty for Albemarle US, Inc. in the amount of $31,600 for NOAV No. 3067, or take other action as appropriate.
Drilling Minerals Industries, LLC - Osino Plant
Alleged failures to construct or operate a stationary source in accordance with any conditon of an operating permit, in violation of Class II Air Quality Operating Permit AP1479-3903.
Recommendation: Approve the NDEP-recommended penalties for Drilling Minerals Industries, LLC - Osino Plant in the amount of $28,900 for NOAV No. 3175, or take other action as appropriate.
NDEP Regulatory Petitions
Permanent Regulation R077-24P: Bureau of Air Quality Planning - Repealing and Amending Regulations to Improve Efficiency in Nevada’s Air Program and Better Serve Public Interests
R077-24P is proposing to repeal the following sections of the Nevada Administrative Code (NAC): 445B.0385, 445B.22057, 445B.2206, 445B.22087, 445B.3621, 445B.3651, 445B.3653, 445B.3669, and 445B.3673; to amend 445B.327 (removing 445B.327(4)(d) and 445B.327(4)(f)); and to amend 445B.281 revising the language on 445B.281(3). The purpose of the proposed amendments is to repeal regulations that no longer serve the purpose of achieving the intents and purposes of Nevada Revised Statutes (NRS) 445B.110 to 445B.640, inclusive. Repealing these regulations is necessary to improve the efficiency in administering Nevada’s Air Program and to minimize the resources needed to understand the regulatory requirements that may affect businesses and the public.
The proposed changes are not expected to have any economic impact on the public, the regulated community, or the Division.
