Penalty Assessments

Wulfenstein Construction Company, LLC.

Alleged failures to construct or operate a stationary source in accordance with any conditon of an operating permit, in violation of Class II Air Quality Operating Permit AP1442-1408.03. 

Recommendation: Approve the NDEP-recommended penalty for Wulfenstein Construction Company, LLC. in the amount of $8,000 for NOAV No. 3071 or take other action as appropriate.

Cyanco Company, LLC.

Alleged failures to construct or operate a stationary source in accordance with any conditon of an operating permit, in violation of Class I Air Quality Operating Permit AP2819-3823.

Recommendation: Approve the NDEP-recommended penalty for Cyanco Company, LLC. in the amount of $13,600 for NOAV No. 3056 or take other action as appropriate. 


NDEP Regulatory Petitions

Permanent Regulation R113-22: Bureau of Water Quality Planning - Establishment of an Antidegradation Policy for Nevada's Surface Waters

R113-22 proposes to amend Chapter 445A of the Nevada Administrative Code (NAC) to establish provisions for antidegradation protection of surface waters of the State as required by NRS 445A.565.

Note that this regulatory petition, R113-22, was previously submitted as R119-20. Additional supporting materials and documents can be found on the NDEP Bureau of Water Quality Planning website

The proposed changes are expected to have some economic impact on the public and on the Division.
