Request for Variance - Star Point Trading MHP RV Park

Background:

The Nevada Division of Environmental Protection's Bureau of Safe Drinking Water (BSDW) received a request for a third extension of the deadline to submit a Corrective Action Plan to address an ongoing violation of the maximum contaminant level (MCL) for nitrate from the Star Point Trading MHP RV Park (Star Point) on December 30, 2025. The BSDW denied this request and issued a Notice of Formal Enforcement on January 29, 2026. On February 23, 2026, the State Environmental Commission (SEC) received a Request for Administrative Appeal Hearing regarding the Notice of Formal Enforcement and Application for Variance from the nitrate MCL. After further discussion with the BSDW, Star Point withdrew the Request for Appeal Hearing. Star Point is still pursuing a variance from the SEC for the MCL for nitrate.       

 

 


NDEP Regulatory Petitions

Permanent Regulation R123-24: Bureau of Administrative Services, Office of Financial Assistance - Revising Clean Water State Revolving Fund Regulations

R123-24 is proposing to amend NAC 445A to amend the Clean Water State Revolving Fund regulations to:

  1. Align with the adoption of Assembly Bill (AB) 20 (83rd Session)
  2. Define the term “affordability criteria,”
  3. Amend the environmental review process,
  4. Amend the administrative fee for loans,
  5. Align state regulations with federal regulations, and
  6. Clean up outdated language and processes.

 The proposed changes are not expected have a significant economic impact on the public, the regulated community, or the Division.

Permanent Regulation R145-24: Bureau of Mining Regulation and Reclamation - Interim Fluid Management

R145-24 is proposing updates to the payment schedule to be deposited in the Trust Fund for Short-Term Fluid Management pursuant to NAC 519A.392. The updates will ensure that the balance of the Fund is sufficient to serve its purpose. Language is also proposed to clarify the permissible uses of the Fund (including investment), that other forms of revenue may be received by the Fund (as per NRS 519A.150(4)), and that the proposed payment schedule is suspended during any year during which the Fund balance reaches or exceeds the target of $15,000,000.

The proposed changes are expected to have some economic impact on the regulated community, and no economic impact to the public or the Division.

Permanent Regulation R146-24: Bureau of Water Quality Planning - Colorado River Salinity and Updates to Names of Waters

R146-24 proposes several changes to NAC 445A to reflect current conditions of stream reaches, existing names of waters, and to assure the most current criteria documents are referenced with regard to water quality standards for salinity of the Colorado River System.

The proposed changes are expected to have minimal economic impact on the public, the regulated community, and the Division.

Permanent Regulation R034-26: Bureau of Sustainable Materials Management - Establishing a Single Regulatory Framework for Hazardous Waste and Secondary Hazardous Materials

R034-26 proposes to establish a single regulatory regime for facilities seeking to manage recyclable materials whether classified as hazardous waste or hazardous secondary materials. This amendment also proposes to establish an annual fee for the Division’s oversight of these types of facilities and existing facilities operating under a written determination authorization from the Division and updates some portions of federal requirements adopted by reference.

The proposed changes are expected to have minimal economic impact on the public, the regulated community, and the Division.
