NDEP Regulatory Petitions
Permanent Regulation R058-26: Bureau of Air Quality Planning - Adopt by Reference
The Nevada Division of Environmental Protection is proposing to ament Nevada Administrative Code (NAC) chapter 445B.221 to adopt applicable federal rules promulgated since the state regulation was last updated in April 2024. This is a routine activity. The update includes rulemakings under 40 CFR Parts 51, 52, 60, and 63.
The NDEP is delegated the implementation of certain federal Non-Source Point Source (NSPS) and National Emission Standards for Hazardous Air Pollutants (NESHAP) rules that apply in Nevada. The proposed amendments update the state's "adoption by reference" regulation so that Nevada can request delegation for the implementation of new and revised NSPS and NESHAP promulgated since the last update. This will allow the regulated industry to continue to work with the state rather than the U.S. Environmental Protection Agency.

Permanent Regulation R116-26: Bureau of Water Pollution Control - Underground Injection Control Program
R116-26 proposes amend NAC 445A to address changes identified through EO2023-003; add definitions; update outdated language; clarify application and testing langauge; update records retention requirements; and correct a minor typo in the existing NAC. These amendment better align state regulations with current federal requirements.
The proposed changes are expected to have some economic impact on the regulated community, and no economic impact to the public or the Division.

Permanent Regulation R142-26: Bureau of Air Quality Planning - PM 2.5 National Ambient Air Quality Standards
R142-26 proposes to amend NAC 445B.22097, "Standards of Qualty for Ambient Air," to revise the Nevada ambient air quality standards table in NAC 445B.22097 to further align with the National Ambient Air Quality Standards (NAAQS) currently in effect. The proposed regulation revises the annual fine particulate matter (PM2.5) standard on the Nevada standards table from 12.0 to 9.0 micrograms per cubic meter.
The proposed amendments address the implementation of the U.S. Environmental Protection Agency's (USEPA) February 7, 2025, PM2.5 NAAQS revision. When the USEPA promulgates a new or revised NAAQS, states must submit a plan which provides for implementation, maintenance, and enforcement of such standard, as stated in the Clean Air Act 42 U.S.C. § 110(a)(1). The proposed PM2.5 standard is already a federal standard applicable nationwide. Adoption at the state level and incorporation into the Nevada State Implementation Plan allows for NDEP implementation.
The proposed changes are expected to have minimal economic impact on the public, the regulated community, and the Division, because the standards are already in place at the federal level. .
