Background of Appeal

On September 19, 2014, the Nevada Division of Environmental Protection (NDEP) issued Solid Waste Disposal Site Permit SW1722REV00 to BedRoc Limited, LLC (BedRoc). This permit authorizes the construction and operation of a Class I disposal site. The facility is located in Lincoln County, Nevada, approximately 65 miles north of Las Vegas.

The disposal site consists of one municipal solid waste landfill unit, contiguous land, structures and other appurtenances and improvements for the disposal of municipal solid waste.

On September 29, 2014, Coyote Springs Investment LLC (Coyote Springs) filed an appeal signed by Emilia K. Cargill, Senior Vice President & General Counsel. 
In summary, Coyote Springs alleges that the NDEP Solid Waste Disposal Site permit issued to BedRoc violates multiple regulatory provisions. Coyote Springs alleges that:

  • The BedRoc permit has not met the prescribed “Location Restrictions” as set forth in NAC 444.678(5) due to issues associated with a Lincoln County Special Use Permit issued to BedRoc in 2003.
  • The BedRoc permit has not met the prescribed “Location Restrictions” as set for in NAC 444.678(9) due to the site’s location in the Pahranagat Wash floodplain.
  • The BedRoc permit has not met the prescribed “Location Restrictions” as set for in NAC 444.678(6) due to the site beautification plans submitted by BedRoc being inadequate.
  • BedRoc does not have an adequate water supply for dust control pursuant to NAC 444.696(2).
