Penalty Assessments
Hiskett and Sons Fallon Batch Plant — NOAV No. 3040
Alleged failures to construct or operate a stationary source in accordance with any condition of an operating permit, in violation of Class II Air Quality Operating Permit AP3273-3931.
Recommendation: Approve NDEP-recommended penalties for Hiskett and Sons in the amount of $1,800 for NOAV No. 3040, or take other action as appropriate.
Hiskett and Sons Flattop Pit — NOAV No. 3043
Alleged failures to construct or operate a stationary source in accordance with any condition of an operating permit, in violation of Class II Air Quality Operating Permit AP1442-3844.
Recommendation: Approve NDEP-recommended penalties for Hiskett and Sons in the amount of $7,800 for NOAV No. 3043, or take other action as appropriate.
F and P Contruction — NOAV No. 3044
Alleged failure to apply for and obtain an Air Quality operating permit.
Recommendation: Approve NDEP-recommended penalties for F and P Construction in the amount of $4,000 for NOAV No. 3044, or take other action as appropriate.
Trex Company, Inc. — NOAV No. 3049
Alleged failure to apply for and obtain an Air Quality operating permit.
Recommendation: Approve NDEP-recommended penalties for Trex Company, Inc. in the amount of $42,000 for NOAV No. 3049, or take other action as appropriate.
Reck Brothers — NOAV No. 2892
Alleged failures to construct or operate a stationary source in accordance with any condition of an operating permit, in violation of Class II Air Quality Operating Permit AP1611-0835.
Recommendation: Approve NDEP-recommended penalties for Western States Gypsum in the amount of $24,000 for NOAV No. 2892, or take other action as appropriate.
PCC Structurals — NOAV Nos. 3045 and 3046
Alleged failures to construct or operate a stationary source in accordance with any condition of an operating permit, in violation of Class II Air Quality Operating Permit AP1499-0504.03.
Recommendation: Approve NDEP-recommended penalties for PCC Structurals in the amounts of $4,000 for NOAV No. 3045 and $14,400 for NOAV No. 3046, for a total amount of $18,400, or take other action as appropriate.
