Permanent Regulation R120-24: Bureau of Air Quality Planning - Aligning Vehicle Emissions Testing Requirements with Nevada Revised Statutes

R120-24 is proposing to amend Nevada Administrative Core (NAC) 445B.592(3) to align with Nevada Revised Statutes (NRS) 445B.825, reducing the need to inspect new motor vehicles until the fourth registration of the vehicle instead of the third. The Nevada Department of Motor Vehicles has approved this regulatory amendment, pursuant to NRS 445B.760. 

The proposed changes are not expected have any economic impact on the public, the regulated community, or the Division.

Permanent Regulation R136-24: Bureau of Water Pollution Control - Amending Water Regulations Relating to Holding Tanks

R136-24 proposes to amend Chapter 445A of the NAC to expand the definition of “holding tank” and to provide an avenue for permitting the temporary storage of domestic sewage in Nevada counties with populations over 700,000.

The proposed changes are expected to have a slight economic impact on the regulated community related to the fee for new permits; however, this impact is expected to be offset by the fact that permittees will be able to operate with the permit. This amendment is also expected to have a slight economic impact on the Division in the form of an increase in permit applications. This amendment is not expected to have any economic impact on the public.

Permanent Regulation R137-24: Bureau of Mining Regulation and Reclamation - Changes to the Fee Structure for the Dewatering of Mines

R137-24 proposes to amend Chapter 445A of the NAC to allow for a comprehensive change to the fee structure for the discharge of groundwater from the dewatering of a mine and water pollution control from mining. These activities are regulated by the Regulation and Closure Program within the Bureau of Mining Regulation and Reclamation. The amendment seeks to increase and modify the fee categories assessed to align the revenue generated by the permits with the increasing costs associated with implementation of the Mining Program. These fees were last modified more than 20 years ago. This amendment also seeks to establish an annual five percent increase of these fees. 

The proposed changes will have a significant economic impact on the regulated community, but are expected to have no negative economic impact on public or the Division.
