Penalty Assessments
Staker and Parson Companies
Alleged failures to construct or operate a stationary source in accordance with any conditon of an operating permit, in violation of a Class II Air Quality Operating Permit .
Recommendation: Approve the NDEP-recommended penalties for Staker and Parson Companies in the amount of $10,000 for NOAV No. 3189, or take other action as appropriate.
Request for Certificate of Designation Variance - 21st Century Environmental Management of Nevada, LLC
Background:
The Nevada Division of Environmental Protection's Bureau of Sustainable Material Management (BMSS) received an application for a Certificate of Designation for an expansion of the 21st Century Environmental Management of Nevada, LLC (21EMN) facility located in Fernley, Nevada. 21EMN is currently operating a Hazardous Waste Treatment and Storage Facility at 2095 East Newlands Drive and is proposing expansion to the neighboring property that shares a property line at 2185 East Newlands Drive. On March, 7, 2025, the BSMM issued a denial letter stating that, per Nevada Administrative Code (NAC) 444.8456 and NAC 444.8458, the proposed expanded facility does not meet the siting requirements. On October 28, 2025, All4 submitted an application for variance to the SEC.

NDEP Regulatory Petitions
Permanent Regulation R123-24: Bureau of Administrative Services, Office of Financial Assistance - Revising Water Quality Standards for Algal Toxins
R123-24 is proposing to amend NAC 445A to amend the Clean Water State Revolving Fund regulations to:
- Align with the adoption of Assembly Bill (AB) 20 (83rd Session)
- Define the term “affordability criteria,”
- Amend the environmental review process,
- Amend the administrative fee for loans,
- Align state regulations with federal regulations, and
- Clean up outdated language and processes.
The proposed changes are not expected have any economic impact on the public, the regulated community, or the Division.
