NOTE: The Nevada Environmental Commission pursuant to NRS 445B.450 (4b) provides that the Commission may determine the appropriate penalty for infractions of Nevada's air pollution control law and regulations. Pursuant to NRS 445B.640 (2) the Environmental Commission established a schedule for administrative fines for lesser violations. Nevada Administrative Code 445B.281 provides this schedule for lesser violations. These lesser violations are processed administratively and do not appear before the Environmental Commission for approval. The Division of Environmental Protection negotiates a settlement with both parties stipulating to the amount of the major violations. These major violations and settlements, as defined in NAC 445B.281 go before the Environmental Commission for review and ratification. If the violator appeals and goes before Environmental Commission as a contested matter the Commission panel then sets the penalty amount. The above listing represents only MAJOR violations. Shown is the date of Commission action (the day of matter was heard and acted upon) the stipulated fine, the number of the finding of alleged violation, and the school district that received the penalty amount.
